Hello, and welcome to our Guidelines and Operational Policies. This is important and affects your legal rights, so please read them and other terms referenced in these documents carefully. Here we go…

1. Introduction

Thanks for working with ESCEI. This is a comprehensive list of our policies and guidelines that dictate how we run our program . Before getting into the details, we’d like to highlight some of the key principles behind it. These principles are important to us because we know they’re important to you.

Our Guidelines and Policy are here to do three things:

  1. Explain the way we use information that you share with us in order to build a better relationship and give you a great experience with it;

  2. Ensure that you understand what information we collect with your permission, and what we do — and do not do — with it;

  3. Hold us accountable for protecting your rights and your privacy under this policy.

2. Drone Footage

ESCEI (El Segundo Cyber Education Initiative) uses UAV’s (Unmanned Aerial Vehicles) for the purposes of recording footage and for educational purposes. ESCEI is not associated with the brands that provide us these vehicles and cannot be held responsible for any damages caused by these parties. The following outlines the terms and conditions under which ESCEI flies it’s UAV’s.

 

ESCEI (El Segundo Cyber Education Initiative) uses its drones and their capabilities for personal and educational uses only. ESCEI does not seek to use its videos containing drone footage for monetization in accordance with FAA Commercial Flight Regulations Article 4, Section 333.

 

ESCEI has used drone footage under a personal flying permit issued by DJI. ESCEI flies its UAV equipment under FAA Part 107 Guidelines for personal use.

 

ESCEI is registered to fly a DJI Phantom 3 Professional Drone under section § 91.203(a)(2) with appropriate permits.

 

ESCEI has 1 registered UAV pilot who is registered in accordance with FAA part 61 pilot certificate licence which can be obtained by contacting eshscompsci@gmail.com

 

ESCEI follows FAA Part 107 as stated below:

 

Unmanned aircraft must weigh less than 55 lbs. (25 kg). • Visual line-of-sight (VLOS) only; the unmanned aircraft must remain within VLOS of the remote pilot in command and the person manipulating the flight controls of the small UAS. Alternatively, the unmanned aircraft must remain within VLOS of the visual observer. • At all times the small unmanned aircraft must remain close enough to the remote pilot in command and the person manipulating the flight controls of the small UAS for those people to be capable of seeing the aircraft with vision unaided by any device other than corrective lenses. • Small unmanned aircraft may not operate over any persons not directly participating in the operation, not under a covered structure, and not inside a covered stationary vehicle. • Daylight-only operations, or civil twilight (30 minutes before official sunrise to 30 minutes after official sunset, local time) with appropriate anti-collision lighting. • Must yield right of way to other aircraft. • May use visual observer (VO) but not required. • First-person view camera cannot satisfy “see-and-avoid” requirement but can be used as long as requirement is satisfied in other ways. • Maximum groundspeed of 100 mph (87 knots). • Maximum altitude of 400 feet above ground level (AGL) or, if higher than 400 feet AGL, remain within 400 feet of a structure. • Minimum weather visibility of 3 miles from control station. • Operations in Class B, C, D and E airspace are allowed with the required ATC permission. • Operations in Class G airspace are allowed without ATC permission. • No person may act as a remote pilot in command or VO for more than one unmanned aircraft operation at one time. • No operations from a moving aircraft. • No operations from a moving vehicle unless the operation is over a sparsely populated area. • No careless or reckless operations. • No carriage of hazardous materials.

3. Creative Commons Use

Creative Commons licenses are not an alternative to copyright. By default, copyright allows only limited reuses without your permission. CC licenses lets our partners and our grant additional permissions to the public, allowing reuse on the terms best suited to specific needs while reserving some rights for ourselves.

 

ESCEI (El Segundo Cyber Education Initiative) utilizes various resources under a creative commons licence. Creative Commons helps us legally share our knowledge and creativity to build a more equitable, accessible, and innovative platform. The specific CC license we use are as follows:

4. Copyrighted Materials Use

ESCEI (El Segundo Cyber Education Initiative) uses various copyrighted materials including but not limited to music, photographs, videos and written statements. This document outlines the guidelines that ESCEI follows when using copyrighted materials as well as providing legal certification of permission to use certain copyrighted materials.

 

MUSIC:

 

ESCEI uses copyrighted Music under the “Fair Use Doctrine” Section 107 of the Copyright Act of 1976. In accordance with “Fair Use” ESCEI uses music in various amounts and substantiality of the portion used in relation to the copyrighted work as a whole. ESCEI uses the following disclaimer when necessary:

 

“This video follows Fair-Use Rules. The video was only made for Artistic Expression, it is purely fan-made. This video is in no way associated with the musical artist or the anime company. All rights belong to their respective owners. Copyright Disclaimer Under Section 107 of the Copyright Act 1976, allowance is made for "fair use" for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use.”

 

VIDEOS:

 

ESCEI uses copyrighted videos mainly for the purpose of promoting our sponsors and partners. Although ESCEI does not obtain express permission before using these materials it is understood that our sponsors and partners are ok with the promotion of their brand and explicit credit is given IN EVERY USE.

5. Trademark Use

ESCEI is an acronym used by many different organizations including our use of El Segundo Cyber Education Initiative. ESCEI is not recognized by the U.S Patent and Trademark Office therefore ESCEI cannot be held responsible for any offences regarding the use of the acronym.  

 

Official Statement:

 

The ESCEI acronym is not recognized by the United States Patent and Trademark Office and therefore any action taken on an improper use of the acronym can not be substantiated. Please refer to the USPTO for further information.

6. Footage and Photo use

ESCEI always obtains permission from attendees before hosting an event to ensure express permission is given to photograph, videotape and audio record participants. While we can provide proof that this permission was obtained we are not able to provide the specific permission forms in accordance with our privacy policy. We will respect the privacy of our attendees and their right to keep their personal information private.

7. Communications

ESCEI Communicates primarily via email (eshscompsci@gmail.com) however ESCEI associates often communicate via personal mediasincluding but not related to personal email, phone number, and social media.

8. How we use the Information we collect

In consideration for the rights granted to you under the Agreements, you grant us the right (1) to provide advertising and other information to you, and (2) to allow our business partners to do the same. In any part of the ESCEI, the Content you view, including its selection and placement, may be influenced by commercial considerations, including agreements with third parties. Some Content licensed or provided to ESCEI (e.g. promo videos) may contain advertising as part of the Content. In such cases, ESCEI will make such Content available to you unmodified.

 

If you provide feedback, ideas or suggestions to ESCEI in connection with ESCEI events or Content (“Feedback”), you acknowledge that the Feedback is not confidential and you authorize ESCEI to use that Feedback without restriction and without payment to you. Feedback is considered a type of User Content.
